Welcome to PhantomHost! These Terms and Conditions ("Terms") govern your use of our web hosting services ("Services"). By signing up for or using our Services, you agree to comply with and be bound by these Terms and any other applicable policies or guidelines published by PhantomHost.
1. Definitions
PhantomHost, we, us, our: PhantomHost Pty Ltd, the provider of the web hosting services.
Customer, you, your: The individual or entity using PhantomHost’s Services.
Services: Web hosting services offered by PhantomHost.
2. Support Scope
Phantom Host provides unmanaged hosting services. By using our services, you acknowledge and agree that support is limited to:
- Issues directly related to the panel and the underlying server infrastructure
- Urgent service level problems, such as server downtime or critical outages
Phantom Host does not provide support for:
- Third-party applications, including CMS platforms (e.g., WordPress), themes, plugins, or custom code
- Email client setup or configuration (e.g., Outlook, Apple Mail, mobile apps)
- Website development, debugging, or content-related issues
Our pricing reflects this self managed model. We make no guarantee of live, phone, or priority support, except where explicitly stated in your plan details.
3. Services and Payment
Payment for new services must be made upfront according to the selected plan. Accounts that register without purchasing a hosting service will be terminated.
Payments for monthly services will be automatically attempted at the time the invoice is generated. All payments must be made within 48 hours of the due date. Failure to pay on time may result in suspension or termination of services.
Invoices for all payments are generated and stored in your PhantomHost account. Customers can access and download these invoices at any time. Invoice emails are not automatically sent for monthly subscription plans unless requested.
Pricing and features are subject to change with notice.
4. Bandwidth Usage (Fair Use)
All PhantomHost plans include bandwidth on a fair use basis consistent with normal website hosting activities.
Our hosting services are designed for typical websites such as blogs, business sites, and small applications. Bandwidth usage must not negatively impact server performance or other customers.
Accounts that generate excessive bandwidth usage or abnormal traffic patterns may be subject to review. We may require the account to reduce usage, upgrade to a more suitable service, or implement caching or optimisation measures.
Services primarily used for high-bandwidth activities such as file distribution, media streaming, backup storage, or similar uses are not permitted on shared hosting plans.
5. Customer Obligations
You are responsible for maintaining the security of your account credentials.
You agree not to use the Services for illegal, harmful, or abusive activities.
You will not upload or distribute malware, spam, or infringing content.
You agree to comply with all applicable Australian laws and regulations.
Any account found to be in breach of these terms may be suspended or terminated indefinitely at our discretion.
6. Data and Content
You retain ownership of all data and content you upload.
You grant PhantomHost a license to use, store, and transmit your data as necessary to provide the Services.
We reserve the right to remove or disable access to content that violates these Terms or applicable laws.
Upon termination, all associated services, accounts, and client data may be permanently deleted and cannot be recovered.
7. Service Availability and Backups
We strive to provide reliable Services but do not guarantee uninterrupted uptime.
Scheduled maintenance and unforeseen outages may occur.
PhantomHost provides nightly backups, which are retained for up to seven (7) days. These backups are offered as a convenience only and are not guaranteed to be complete, accurate, or successfully restorable. You are solely responsible for maintaining your own independent backups. PhantomHost accepts no liability for any data loss, corruption, or restoration failure.
8. Limitation of Liability
PhantomHost is not liable for any indirect, incidental, consequential, or punitive damages.
Our maximum liability to you for any claim related to the Services is limited to the amount you paid us in the last 6 months.
We do not guarantee the security or confidentiality of data transmitted over the internet.
9. Termination and Suspension
We may suspend or terminate your account for breach of these Terms or illegal activities.
You may cancel Services at any time by providing notice.
Upon termination, your data may be deleted after a grace period.
10. Intellectual Property
All intellectual property rights in our Services and website remain with PhantomHost.
You must not copy, modify, or distribute our content without permission.
11. Privacy
Your use of the Services is subject to our Privacy Policy which explains how we collect and use your personal information.
12. Governing Law
These Terms are governed by the laws of the Commonwealth of Australia. Any disputes will be resolved in Australian courts.
13. Changes to Terms
We may update these Terms from time to time. Updates can be seen on our website.
